Kuwait Anti-Corruption Authority (Nazaha) has referred former leaders in the Ministry of Health (MOH) and others to the Public Prosecution on suspicion of committing the crime of causing damage to state funds due to negligence. This action is in accordance with Article No. 14 of Law No. 1 of 1993 on the Protection of Public Funds, and Article No. 22, item (1) of Law No. 2 of 2016 on the establishment of Kuwait Anti-Corruption Authority.
Nazaha stated that the referral follows an investigation and the collection of inferences. It emphasizes that this action is part of its ongoing efforts to combat corruption, prevent its negative impacts, prosecute wrongdoers, and enforce its authority. This is as outlined in Article 5 (item 2) that states that Nazaha shall “receive and study the reports, complaints and information submitted to it concerning corruption offences, and when ascertained that they constitute a suspicion of a crime, such reports shall be referred to the competent investigative body.”
Furthermore, Nazaha affirms its commitment to continue its efforts and procedures in examining and gathering evidence related to credible information that meets the necessary requirements. Nazaha acknowledges and values the pivotal role of whistleblowers in assisting it to obtain the essential information and data concerning corruption crimes. Additionally, Nazaha is steadfast in its commitment to ensuring the highest levels of protection and confidentiality for whistleblowers, in accordance with its establishment law and executive regulations.
